Who we are

This website is operated by Fresh Start Furniture LLC ("Fresh Start Furniture," "we," "us," or "our"), an Oregon limited liability company located at [full warehouse address]. By placing an order or using this site, you agree to these terms.

Products and condition

We are an independent reseller of open box, overstock, and new in box furniture from premium manufacturers. We are not affiliated with, authorized by, sponsored by, or endorsed by any manufacturer or brand whose products we resell. All brand names and trademarks referenced on this site are the property of their respective owners and are used only to describe the products we sell.

Product photos are representative. Because our inventory is open box, individual pieces may show minor variation from the photos shown. We describe the condition of each piece as accurately as we can, and you have the right to inspect the actual piece at delivery before accepting it.

Pricing and availability

All prices are listed in US dollars and are subject to change without notice. Our inventory is limited and moves quickly. If an item you ordered is no longer available, we will contact you promptly and issue a full refund or offer a comparable piece.

We make every effort to keep listings accurate, but errors in price, description, dimensions, or availability can occur. We reserve the right to correct any error and to cancel any order placed on incorrect information, with a full refund issued.

Payment

Orders are paid in full at the time of purchase, including pre-orders. We accept the payment methods shown at checkout. Delivery fees, where applicable, are quoted before your order is finalized.

Your responsibility at delivery

You are responsible for confirming that the piece you order will fit through your entry points and into the intended room. Measure your doorways, hallways, stairwells, and elevators before your delivery date. Our crew will do their best to make it work, but they will not remove doors, windows, or railings, and they cannot hoist furniture over balconies.

Someone eighteen years or older must be present to receive and inspect the delivery.

Title and risk of loss

Title and risk of loss pass to you at the moment the delivery is accepted, which is when our crew leaves your property, or when the item leaves our warehouse if you are picking it up.

Warranty

We do not provide our own warranty on the furniture we sell. Where the original manufacturer warranty applies and is transferable, it passes to you. Warranty claims are handled by the manufacturer directly.

Limitation of liability

To the fullest extent permitted by law, Fresh Start Furniture LLC is not liable for indirect, incidental, or consequential damages arising from your purchase or your use of this site. Our total liability for any claim will not exceed the amount you paid for the item in question.

Governing law

These terms are governed by the laws of the State of Oregon, without regard to conflict of law principles. Any dispute will be resolved in the state or federal courts located in [Lane County], Oregon.

Changes to these terms

We may update these terms at any time. The version posted on this page at the time of your order is the version that applies to your order.
